What is a Bail Bond?

A bail bond is a court document that secures the release of a defendant in custody. This document also ensures that the defendant will appear at all required court hearings.


How does a bail bond work?

After a defendant has been arrested, the bail amount is set by the judge. Once bail is set, someone will contact the bail agent on behalf of the defendant to arrange the posting of the bail bond. This person will become the indemnitor or co-signer guaranteeing the bond. The indemnitor will complete all necessary paperwork and pay the bond premium (usually 10%). Once the indemnitor has signed the paperwork, he or she is guaranteeing that he or she will pay the full amount of the bond if the defendant does not appear in court. The indemnitor may also have to provide collateral to secure the guarantee.


Who is an indemnitor/guarantor?

An indemnitor or guarantor is a friend or family member of the defendant. This person agrees to cover the full amount of the bond if the defendant does not show up for court.


How does the collateral process work?

Depending on the amount of the bond, the bail bondsman may require the indemnitor to secure the bond with collateral. Collateral can be anything of value that can cover the amount of the bond, including jewelry, cash, property, cars, etc. The collateral will be returned to the indemnitor as soon as the defendant’s case is completely resolved.


When do I get my collateral back?

Once the bail bond has been discharged or exonerated, collateral will be returned by the bail bondsman.


How is bail determined?

The judge or magistrate sets the bail amount based on a number of factors: the nature and severity of the crime; the weight of the evidence; and the character and history of the defendant. Many states also have a bail schedule. This is a guideline that lists bail amounts and ranges for specific crimes.


How can I pay for a Bail Bond?
